This is a motion made for summary judgment in favor of the plaintiff pursuant to rule 113 of the Rules of Civil Practice of the state of New York.

The complaint alleges the making and delivery of a bond to the plaintiff by the defendants in the sum of $5,000, the condition of the bond being that, if the principal, Fiedler (one of the defendants herein), return the motorboat Pal, her tackle and equipment, to the custody of the marshal...
