The Riggs National Bank brought suit against the District of Columbia to recover taxes paid under duress and protest. Defendant filed a motion to dismiss, which was treated as a general demurrer and overruled by the trial justice, whereupon defendant elected to stand upon its demurrer, and judgment accordingly was entered for the plaintiff. From the judgment this appeal was prosecuted.
