This is an appeal from a judgment in an action at law in which a jury was waived by the written consent of the defendants. The case was dismissed by the court for want of jurisdiction. In the amended petition the plaintiffs were Nancy Bell Cushny and Nancy Bell Cushny, trustee. The defendants were J. R. Crowe, Jr., and Theodore Remley, trustee.
