The St. Louis-San Francisco Railway Company brought this action against Ralph H. Blake, as county treasurer of Creek county, Oklahoma, under the provisions of section 9971, C. O. S. 1921, to recover certain taxes assessed for the year 1925 in Creek county, Oklahoma, on the ground that the levies, upon which such taxes were based, were illegal.
