By act of the General Assembly of Georgia of 1915 (Georgia Laws 1915, p. 233) the office of county treasurer of Fayette county, Georgia, was abolished after the 1st day of January, 1917. The further pertinent provisions of the said act are as follows:

"* * * The commissioners of roads and revenues of said Fayette county shall by a majority vote taken among themselves, select some bank, banks...
