Salvatore Lo Pizzo, the appellant, was arrested on a warrant dated February 8, 1928, issued by Judge Thompson, of the Eastern district of Pennsylvania. The warrant was based on a mandate of the Secretary of State, dated March 3, 1927, which recited a treaty (15 Stat. 629) with the Kingdom of Italy providing for the extradition of persons accused of crime.
