This is an appeal, in an interference proceeding, from the decision of the Commissioner of Patents awarding priority of invention to appellee. The invention relates to resistor grids for electric furnaces.

Several counts were involved in the original interference. The issue presented here, however, is limited to count 2, which reads as follows:

"2. A grid formed of a bar of substantially T-shaped, cross-sectional shape bent...
