Herault A. Trester, the appellant, claiming to be the first inventor of certain new and useful improvements in curb forms, applied for a patent March 15, 1922, filing nine claims in said application. On June 2, 1926, the Examiner allowed claims 7 and 9 and rejected claims 1 to 6, inclusive, and claim 8. This decision was affirmed on September 20, 1927, by the Board of Appeals, following which the appellant appealed to this court, claiming...
