The defendant in error (hereafter called plaintiff) began suit against the receiver of the People's National Bank of Hot Springs, S. D., praying for the declaration and enforcement of a trust. The plaintiff was the payee of three cashier's checks issued by the Stockman's Bank of Hot Springs, dated December 9 and 10, 1924.
