The nominal plaintiff in this action is the Anglo Oesterreichische Bank, a banking corporation, and a citizen of Austria, its claim, by assignment, having devolved on Meyer Grouf, a citizen of the state of New York, as use plaintiff. No intervening rights being involved, this bank, located in the city of Vienna, will herein be designated as the plaintiff.

The action is brought in assumpsit against the First National Bank at Pittsburgh...
