Plaintiff in error, called defendant, and another were put to trial on nine counts of an indictment. The first count charged them with a conspiracy to violate the National Prohibition Act (Comp. St. § 10138¼ et seq.), and on this charge they were both acquitted by the jury, and the other defendant was acquitted also on the eight remaining counts, this defendant (plaintiff in error) being convicted and sentenced on each thereof.
