This is an action by the trustee in bankruptcy to recover $5,000 paid to the defendant on December 10, 1924, five days before the filing of a petition in bankruptcy against the Kewa Novelty Co., Inc., a New York corporation. The payment was made by check signed by two officers of the bankrupt corporation, William Kunstler, president, and I. G. Altman, treasurer; these two officers being also indorsers on the paper.
