This was an action by Herman P. Harris, trading as Harris & Co., against Charles F. Newsom, for damages resulting from alleged breach of contract for sale of 1,000 tons of alfalfa hay by defendant to the plaintiff. Briefly stated, it is in substance alleged by the plaintiff: That he entered into a written contract, exhibited on his petition, for the purchase of 1,000 tons of alfalfa hay of different grades.
