This is an action to quiet title to certain lands, and is before this court for the determination of those questions for which the case was remanded. The facts in the case are substantially as set forth in the case of Barnett v. Kunkle, 256 F. 644, 168 C. C. A. 38, and in brief are that one Annie Bird, a full-blood Creek Indian, died in September, 1909, intestate and without issue, seized of the lands in question as her allotment. She left...
