Plaintiffs, who are respectively the widow and four children of one John A. Simmons, deceased, sued defendant for damages caused by the death of their decedent, accruing through alleged negligent acts of defendant.

Decedent came to his death on the 3d day of April, 1910. The instant action was begun on the 10th day of May, 1924. When this suit was commenced, plaintiffs were of the ages following: Eliza Simmons was 46 years of age; Thomas...
