The plaintiff in error, hereinafter called the defendant, was indicted with George W. Hunt and John G. Schlieff for violation of the National Prohibition Act (Comp. St. § 10138¼ et seq.). The indictment contained three counts. The first count charged unlawful transportation of intoxicating liquor; the second, unlawful possession; and the third, importing and bringing into the United States "without the payment of the lawful revenues...
