This is a writ of error from a conviction on an indictment charging conspiracy to violate the National Prohibition Act (Comp. St. § 10138¼ et seq.).

This indictment covered eight men. At the end of the government's case, three of the defendants, including this plaintiff in error, pleaded guilty and the government entered a nolle as to the other five. About four months after sentence...
