This suit was commenced in the superior court of New Hanover county, N. C., and was removed to this court by the defendant. The bill of complaint contains two distinct causes of action, in the first of which the plaintiff Cox, as trustee, seeks to recover a fund alleged to have been held by the Commercial National Bank as trustee for bondholders, and to have passed into the hands of the defendant receiver impressed with a trust in his favor...
