GIBSON, District Judge.
The plaintiff charges infringement by defendants of letters patent No. 935,205, for a railway frog, granted September 28, 1909. The application was filed July 10, 1906.
The defendants allege that the claims of the Hitchcock patent are invalid and void because involving no new structure in railway frogs in view of the prior art and prior use.
