In this case the right of the city of Galveston to levy a tax on oil brought into Galveston in tank steamers from Mexico, and from Galveston distributed under prior contract to the Missouri, Kansas & Texas Railway at Galveston and to interstate buyers out of Galveston, with a few sales spot, is conceded, unless (1) the tax upon the oil would be a tax on imports, prohibited by the federal Constitution; or (2) would constitute a burden...
