This action was commenced in the circuit court of Fayette county, Ark., in April, 1924, by J. L. Ware, defendant in error (who for convenience, however, will be designated as plaintiff), against the Texas Pipe Line Company, plaintiff in error (designated as defendant), to recover damages in the sum of $10,000 for personal injury to plaintiff while in the employ of defendant.
