The petition in bankruptcy in this case was filed May 25, 1922, and on the same day the petitioner here, who was one of the petitioning creditors, asked for the appointment of a receiver to take charge of the bankrupt's property. Instead of appointing a receiver, the court appointed the respondent, the marshal, who took charge of the property and cared for it. On June 30, 1922, an order of adjudication was entered and the case was referred...
