Jose Balcarcel was employed as a fireman on the tug Clarence P. Howland, and on the 11th of August, 1922, lost his life when the tug collided with the ship Roanoke. His widow, as administratrix, seeks to recover damages for his death against the tug owner, and instituted a suit in the state Supreme Court.
