Charlie Johnson, the defendant below, was indicted, tried, and convicted of feloniously selling whisky to Ben Andrews on or about June 11, 1920, in Osage county, Okl. At the close of the evidence at the trial counsel for the defendant moved the court to instruct the jury to return a verdict in his favor on the ground that the evidence was insufficient to sustain a verdict against him.
