MR. JUSTICE PITNEY, after making the foregoing statement, delivered the opinion of the court.

The trial judge in submitting the case to the jury adopted the following construction of the contract of November 29, 1902: That it provided for a general scheme to be carried out within the period of two years; that control of the Turquoise Company was to be given to defendants McKittrick and Tevis, and with a board of directors...
