MR. CHIEF JUSTICE FULLER delivered the opinion of the court.

Inasmuch as the validity of the statute of Texas authorizing the recovery of damages and attorneys' fees for failure by life and health insurance companies to pay losses was seasonably drawn in question by defendant below as being in contravention of the Constitution of the United States, we think the case comes within Loeb v. Columbia Township Trustees, 179 U.S. 472
