Neither the testimony nor the instructions are preserved in the record, and the only questions presented for our consideration arise on the indictment.

It is objected, in the first place, that the indictment lacks the indorsement, "a true bill" as well as the signature of the foreman of the grand jury. No objection was made on this ground...
