JANE BLAND, Justice.

This proceeding arises from a personal injury sustained by George Matthews, the real party in interest, alleged to have occurred during his employment at sea off the Virginia coast. His employer, Omega Protein, Inc. ("Omega"), the relator, seeks mandamus relief, requesting that we order the trial court to dismiss the underlying suit for re-filing in Virginia.1
