U.S. v. SCROGGINS

No. 10-3641.

648 F.3d 873 (2011)

UNITED STATES of America, Appellee, v. Christopher J. SCROGGINS, Appellant.

United States Court of Appeals, Eighth Circuit.

Filed: August 9, 2011.

Attorney(s) appearing for the Case

Stephen C. Moss , Asst. Fed. Public Defender, Kansas City, MO ( Raymond C. Conrad, Jr. , Fed. Public Defender, on the brief), for appellant.

David A. Barnes , Asst. U.S. Atty., Kansas City, MO ( Beth Phillips , U.S. Atty., on the brief), for appellee.

Before RILEY, Chief Judge, SMITH, Circuit Judge, and STROM, District Judge.

RILEY, Chief Judge.

Christopher J. Scroggins appeals the district court's2 denial of his motion to allow the jury to view, in person, the area beneath the console of his car where police discovered a hidden firearm. Scroggins argues the district court's ruling was an abuse of discretion and violated Scroggins's Fifth Amendment due process right to present a defense. We disagree and affirm.
