Desirae Lupien appeals from the judgment entered in favor of The Vons Companies Inc., on her complaint, after Vons' motion for summary judgment was granted. We reverse.

Lupien also challenges an order that she and counsel, jointly and severally, pay a portion of fees of a discovery referee appointed by the court. We affirm the order that Lupien pay those fees, but reverse the order...
