OPINION

MOORE, J.

A jury found defendant Wendell Patrick Lemond guilty of murder in the first degree. The court sentenced him to 25 years to life in state prison. The trial court did not err in not instructing the jury regarding a killing which occurs during a heat of passion. We affirm.
