The agreed facts determined at a pre-trial hearing (Rule 16, Federal Rules of Civil Procedure, 28 U.S.C.A. following section 723c,) disclose that since January, 1934 the plaintiff has been engaged in the business of distilling and selling alcohol and alcoholic liquors, particularly gin and whiskey.
