In July 2002, defendant was drinking beer with two other homeless men on Mission Inn Avenue in Riverside. Defendant, who had marijuana in his pocket, was asked by one of the men if he would sell him a "joint." Defendant refused to sell to the man, and the man made an offensive remark.
