ORDER ACCEPTING FINDINGS AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE

DAVID O. CARTER, District Judge.

Pursuant to 28 U.S.C. § 636, the Court has reviewed the records on file, including the Fifth Amended Complaint, the Report and Recommendation of the assigned United States Magistrate Judge, the Objection, Request for Supplementary Attachments and Request for Reconsideration filed by Plaintiff, and the Reply to Objection filed by Defendants. Further, the Court has engaged in a de novo review of those portions of the Report and Recommendation to which objections have been made.

IT IS HEREBY ORDERED that:

1. The Report and Recommendation is approved and accepted; 2. The Defendants' Motion to Dismiss the Fifth Amended Complaint (Dkt. 99) is GRANTED; 3. Plaintiff's Fifth Amended Complaint is dismissed without leave to amend and with prejudice; and 4. Judgment shall be entered accordingly.
