Kenneth Paul Jones, Plaintiff, Pro Se.

JUDGMENT

ELIZABETH ERNY FOOTE, District Judge.

To date, Plaintiff has failed to file an amended complaint in compliance with the Magistrate Judge's order dated June 22, 2016 [Record Document 9]. Plaintiff has filed what purports to be an answer to the Report and Recommendation of the Magistrate Judge, though the filing does not substantively respond to the Report and Recommendation, nor does it comply with the Court's previous order. Thus, for the reasons stated in the Report and Recommendation of the Magistrate Judge previously filed herein, and after an independent review of the record, and determining that the findings are correct under the applicable law;

IT IS ORDERED that Plaintiff's complaint is DISMISSED WITHOUT PREJUDICE, for failure to prosecute, pursuant to Rule 41(b) of the Federal Rules of Civil Procedure.
