RODRIGUEZ v. STATE

Case No. 5D15-3622.

210 So.3d 750 (2017)

Marco Antonio RODRIGUEZ, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Fifth District.

Opinion filed February 10, 2017.

Attorney(s) appearing for the Case

James S. Purdy , Public Defender, and Ali L. Hansen , Assistant Public Defender, Daytona Beach, for Appellant.

Pamela Jo Bondi , Attorney General, Tallahassee, and Pamela J. Koller , Assistant Attorney General, Daytona Beach, for Appellee.

Marco Rodriguez appeals his convictions for lewd or lascivious molestation. The jury may have reached the proper verdict, given the evidence in this case. However, there is no doubt that Appellant was denied a fair trial due to egregious prosecutorial misconduct, compounded by defense counsel's unexplained failure to object.
