This action is before the Court upon Defendant Frito Lay North America's ("Frito Lay") Motion to Dismiss (ECF No. 57) pursuant to Federal Rule of Civil Procedure 12(b)(6). For the reasons provided below, the Court grants Frito Lay's Motion to Dismiss.
