¶ 1 In May 1999, Petitioner Taberone Dave Honie was convicted of aggravated murder. Mr. Honie waived his right to a jury at sentencing and was subsequently sentenced to death by the trial judge. Following an unsuccessful direct appeal, Mr. Honie sought postconviction relief pursuant to the Utah Post Conviction Remedies Act (PCRA).
