IN THE INTEREST OF T.C.A.

No. 07-17-00134-CV.

IN THE INTEREST OF T.C.A. AND M.A.A., Children.

Court of Appeals of Texas, Seventh District, Amarillo.

Attorney(s) appearing for the Case

Leonard R. Morgan , for Gwendolyn Abell a/k/a Gwendolyn M. Reed, Appellee.

Justin M. Jackson , for Brian S. Abell, Appellant.

Before QUINN, C.J., and CAMPBELL and PIRTLE, JJ.

MEMORANDUM OPINION

PER CURIAM.

Appellant, Brian S. Abell, filed a notice of appeal in the above referenced cause without paying the requisite filing fee. By letter dated April 26, 2017, the clerk of this court notified Abell that failure to pay the filing fee by May 8 would result in dismissal of the appeal. See TEX. R. APP. P. 42.3(c). On May 10, 2017, Abell filed a motion to voluntarily dismiss his appeal. However, he has not paid the filing fee to date.

Because Abell failed to comply with a requirement of the appellate rules and a notice from the clerk requiring action within a specified time, we dismiss the appeal. See TEX. R. APP. P. 42.3(c). Abell's motion to voluntarily dismiss the appeal is, therefore, moot.
