A jury found appellant, Harry Dane Drew, guilty of a second offense of driving while intoxicated. See Tex. Penal Code Ann. § 49.04(a) (West 2003), § 49.09(a) (West Supp. 2008). The trial court assessed punishment at 365 days in the Bell County Jail, plus a fine of $500 and court costs.
