Ordered that the amended judgment is affirmed.

As an initial matter, contrary to the People's contention, the defendant's written waiver of the right to appeal was not valid (see People v Keiser, 100 A.D.3d 927, 928 [2012]). The record does not demonstrate that the defendant grasped the concept of the appeal waiver and the nature of the right he was forgoing (see People v Bradshaw, 18 N.Y.3d 257
