GASKINS, J.

The plaintiff, Tealwood Properties, LLC, appeals from a trial court judgment sustaining an exception of res judicata filed by Dale Oil Company, Inc. d/b/a Dale Oil Corporation ("Dale"). For the following reasons, we reverse the trial court judgment and remand to the trial court for further proceedings.
