STATE v. BROWN

No. 2011-KA-0947.

88 So.3d 662 (2012)

STATE of Louisiana v. Natasha S. BROWN.

Court of Appeal of Louisiana, Fourth Circuit.

March 7, 2012.

Attorney(s) appearing for the Case

Leon A. Cannizzaro, Jr. , District Attorney, Matthew Caplan , Assistant District Attorney, New Orleans, LA, for Appellant.

Verity Gentry Bell , James Harper , Orleans Public Defenders, New Orleans, LA, for Defendant/Appellee.

(Court composed of Judge EDWIN A. LOMBARD, Judge PAUL A. BONIN, Judge ROSEMARY LEDET).

ROSEMARY LEDET, Judge.

This is a criminal case. The State is the appellant. The sole issue presented is whether the district court erred in granting the motion to quash the bill of information filed by the defendant, Natasha Brown, after the State entered a nolle prosequi on the day of trial and eight months later reinstituted the charge. Answering that question in the affirmative, we reverse and remand.
