Plaintiff Cytomedix has sued Perfusion Partners & Associates Inc. (PPAI), and three individually named PPAI employees, Emery Smith, David Buzenius, and Patrick Pennie for patent infringement and Lanham Act violations.1 Defendants have moved to dismiss for lack of jurisdiction and for failure to state a claim.
