[¶ 1.] Pursuant to SDCL 16-19-67, the Disciplinary Board of the State Bar of South Dakota filed a formal accusation against attorney Jon Mattson. The Disciplinary Board recommended that Mattson be suspended from the practice of law for three years. SDCL 16-19-35(2). Following a hearing, the Referee, Circuit Court Judge Rodney J.
