In 1988 Cook County adopted an ordinance, here challenged as a denial of equal protection of the laws, establishing a "Minority- and Women-Owned Business Enterprise Program" (the "M/WBE" program, the parties call it), which requires that a minimum of 30 percent of the total value of any construction contract made by the County be awarded to enterprises at least 51 percent owned by members of specified minority groups such as blacks and Hispanics...
