THIS MATTER is before the court pursuant to 28, United States Code, Section 636(c). Defendants have moved for summary judgment and supported their motion with a memorandum of law. In response, plaintiff has filed a timely memorandum in opposition, to which defendants filed a reply. On May 2, 2000, oral arguments were heard.
