This is an appeal from a summary judgment granted in favor of Pilgrim's Pride Corporation and Patrick Pilgrim ("Defendants or Appellees"). Susan and Ray Nugent's suit alleged trespass and temporary damage to their farm by Defendants' negligent or grossly negligent dumping of noxious and toxic chemicals and chicken waste on the adjoining farm.
