CHAPMAN, Justice.

The State appeals from an order granting appellee Michael Horner's motion to dismiss with prejudice a murder indictment based on preindictment delay. The State contends that the trial court erred in its determination that the State's indictment of Horner over eleven years after the murder violated Horner's speedy trial and due process rights.
