Jolene Pausch was found guilty of the second degree murder of her son and sentenced to a life term of imprisonment. She was also convicted of aggravated abuse of the child and sentenced to a concurrent 15 year term, a period in excess of the guidelines range. She challenges the convictions and the departure sentence. Pausch is entitled to a new trial based upon the trial court's determination to permit the jury to hear a tape recording of her post-arrest...
